As
the Creditor, do you know the ‘rules of the bankruptcy and estate
game’? Do you know that bankruptcy and probate proceedings require
immediate and continued attention if one hopes to have its claim satisfied
to the fullest extent possible? Do you know that the approach that is
immediately taken from the Creditor perspective can make all the difference
in the world as to your eventual dollar outcome? Do you know the players
in the bankruptcy and estate game? Do you know what strategies apply to
this bankruptcy and estate game? Do you, the Creditor, know how to execute
and follow through on the game?
In theory, bankruptcy and estate law is intended to balance the power
between debtors and creditors; in practice, the balance can be easily
skewed to one side or the other. The prudent Creditor needs to protect
itself in the world of bankruptcy and probate by ensuring that the scale
does not tip too heavily toward the debtor. Often a Creditor may not recognize
that they have archaic bankruptcy and probate procedural and operational
issues. Therefore, it may be very important to audit or have someone else
audit the process.
So, it is time for your organization to remember, “…some
people skate to the puck…let us skate to where the puck should be…”
