RESPONSE: The debt collector can accept any additional payment
the mother may wish to make on her daughter’s account. However,
he cannot give her any details concerning her daughter’s debt other
than to provide her with a receipt for any amount she may pay on this
account i.e. no communication should take place between the mother and
the debt collector concerning the daughter’s debt.
PROBLEM #2: Cindy Debtor made a consumer installment
purchase of a computer from a retail appliance and computer store for
her home office for use in her business as a consultant and is now considerably
past due in her payments. Her account has been passed to a collection
agency and from there to a collection attorney’s law firm. Is this
debt covered under the FDCPA? Why or why not?
RESPONSE: Yes. This was an consumer installment contract.
Therefore, this debt is a personal debt guaranteed by the person who signed
the installment agreement prior to receiving the computer. It is not a
business debt even though she is using the computer in her home-based
business. The purpose for which she is using the computer is not relevant.
Also, the collection attorney who is handling Cindy’s account is
required to comply with the FDCPA.
