CREDITOR: any person who offers or extends credit thus
creating the debt. It also includes any creditor who uses a name other
than his/her own when collecting a debt. This term does not include any
person or organization who receives an assignment of a debt (which is
in default ) for the purpose of facilitating the collection of this debt
for another person or organization, as in the case of a collection agency
or a collection law firm.
DEBT: any obligation or alleged obligation of a consumer
to pay money arising out of a transaction in which the money, property,
insurance, or services (which are the subject of the transaction) are
primarily for a person, family, or household. Note: a debtor’s obligation
to pay includes both debts incurred by the individual, his/her family
or household and also, those debts which are the result of legal judgments
against an individual which are obtained through the courts.
HOWEVER, BUSINESS OR COMMERCIAL DEBT IS NOT COVERED BY THE FDCPA.
For example: If a purchase is made for an office located
in a home by an individual who signs his/her own name to the contract,
then this debt is covered by the FDCPA. However, the FDCPA would not cover
a debt for a purchase made in the name of a business, even if the business
