In Section 1692a of the FDCPA, specific definitions relating to debt and
the persons involved in the debt collection process are provided. They
include:
COMMISSION: The Federal Trade Commission (also known
as the FTC) is charged with enforcing the provisions of the Federal Debt
Collection Practices Act (also known as the FDCPA).
COMMUNICATION: the means of conveying information regarding
a debt directly or indirectly to any person through any medium (telephone
call, letter, telegram, use of Braille, or sign language, etc.)
NOTE: the FTC has indicated that a debt collector can accept payment
from a friend or relative (a third party) on a debtor’s account
and provide a receipt for the payment without a “communication”
having taken place, if the debt collector does not provide the friend
or relative with any details of the debt. For more clarification about
the FDCPA’s restrictions on debt collectors’ communications
with third parties, see Sections 1692b, 1692c and 1692d.
CONSUMER: any natural person obligated or allegedly obligated
to pay any debt. Even though Congress has chosen to use the word “Consumer”
throughout the FDCPA, third party collection agencies use the word “Debtor”.
Both words are used interchangeably in this training module.
